Welcome to the BySymphony Website ("Website"). By entering our Website, you agree to these terms and conditions (the "Terms"). Please review these carefully prior to making any purchases. By using this site you agree to comply with these Terms.
BySymphony is an online service of Symphony Style LLC (“Symphony”) for the purpose of the sale of clothing, accessories and other items ("Product").
In order to be able to make purchases through the BySymphony website, you will be requested to register. The information sought will allow BySymphony to handle your transaction efficiently and effectively.
As payment will be made online, it is important that you enter all the requested information accurately. This will ensure that there is no delay in the dispatch of your order. The information provided will be treated in the strictest confidence. We do not share any customer data to any third parties and all customer data is held on a secure server.
The website is available only to individuals who meet the BySymphony terms of eligibility, who have been issued a valid payment card, i.e., credit card etc. and who have authorized BySymphony to process a charge or charges on their payment card in the amount of the total purchase price for the item or items.
By making an offer to purchase merchandise, you authorize BySymphony to perform credit checks and to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your payment card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your payment card, to obtain an initial payment card ld.
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorized to use.
BySymphony may use the information you provide to conduct suitable anti-fraud reviews, the agency involved may keep a record of that information.
We reserve the right to restrict multiple quantities of a specific item being shipped to any one customer or postal address.

BySymphony may modify these Terms at our sole discretion. If you do not agree to the changes to these Terms, you should stop using this website. By using this website after any such change(s), you agree to comply with the Terms as changed. Any changes made after you have placed an order with us, will not affect that order, unless we are required to make the change by law.
Making a purchase
When you make a purchase through the BySymphony website, you are offering to buy Product(s) for the price stated, subject to these Terms.
All orders are subject to acceptance and availability.
Placing an Order
The Website contains an instructive guide that will walk you through the process of placing an order. You place your order for any selected items by clicking on the [Confirm Order] button at the end of the online order process.
Once you have placed your order, you will receive an email acknowledging the exact details of your order, providing you with a payment reference code and the value of your order that will be debited from your Payment card.
Please note that while the Website lists only available Product, there may be occasions due to circumstances beyond BySymphony’s control, where the Product is not available. In this case a latest delivery, where applicable, will be communicated to you or an immediate refund of any unavailable goods made.
Unless otherwise notified, BySymphony’s acceptance of your order occurs when you receive an email notifying you that we have dispatched the Product(s) as ordered by you and noted on that communication. Acceptance will be deemed to have occurred at the sending of this communication, regardless of technical problems you may experience, where the reasons are outside BySymphony's control, which may result in you having not received that email in a timely manner.
If you require any information regarding your order(s), please contact Customer Care on +9714 3106904 during our office hours of 8:30 am till 5:30 pm (GMT+4). BySymphony may not accept your order if: an item you have ordered is out of stock or we are unable to obtain authorization for your payment.
We reserve the right to reject any offer to purchase by you at any time and at our sole discretion.
Pricing Policy
At the BySymphony website you are given an opportunity to view products in your preferred currency. You may choose between US Dollar, Saudi Riyal, Bahraini Dinar, Omani Rial, Qatari Rial and UAE Dirham. Price converters are located in the top left corner of the website page. However, the final checkout price will be charged in AED and if you purchase using a payment card denominated in a different currency to AED, the payment will be subject to the currency exchange rate applied by your card issuer at the time your payment is completed.
All currency priced items will be honored as advertised unless it is obviously incorrect.
For International orders, BySymphony offers our customers the Delivery Duty Unpaid (DDU) system, which means that you will be charged for the items purchased plus shipping cost only and any import duty and tax liable as part of your order will have to be paid to the shipping company upon receipt of the goods.
Product prices are set at the beginning of each season, using existing currency exchange rates. The rates are subject to variation and may go up or down; therefore, prices are subject to change if the applicable currency exchange rate changes before your order is accepted or the items are markdown at any time during the selling period.
Payment
Payment will be debited and cleared from your account upon dispatch of your order from the BySymphony website.
You confirm that the Payment card that is being used is yours or that you have been specifically authorized by the owner of the Payment card to use it. All Payment card holders are subject to validation checks and authorization by the card issuer.
If the issuer of your payment card refuses to authorize payment, BySymphony will not be liable for any delay or non-delivery.
The BySymphony website is fully secure and is protected by Verisign.
All Payment card transactions on the Website are processed using a secure online payment gateway that encrypts your card details in a secure host environment.
To help ensure that your shopping experience is safe, simple and reliable, the Website uses Secure Socket Layer (SSL) technology.
All reasonable care, as it is in BySymphony’s power to do so, to keep the details of your order and payment secure. In the absence of negligence on our part, BySymphony cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.
Returns
If a customer is not happy with their purchase, they may return or exchange the purchased items within 30 days of receipt of the goods. Satisfaction is always a top priority and as such each query is addressed individually to the best of our ability.
All refunds will be issued as coupon codes, which will be valid for 6 months. This will exclude shipping costs (with the exception of faulty items), which we deduct to cover the cost of our collection service.
Customs duties and sales taxes are non-refundable. Please note that exchanges will be submitted through the same customs procedures, therefore are applicable for duty and tax again.
Please be aware that in order to receive a refund or exchange, the item(s) must be unworn and in perfect condition, with all the labels attached and in the original packaging. Where provided, any designer packaging such as authenticity cards, dust bags and leather tags should be included as part of your return. Altered or resized items are not eligible for returns/exchanges. We will not accept returns that do not adhere to the specified conditions outlined.
Briefs, swimming costumes and bikini bottoms should be tried on over underwear. Returns may not be accepted if the protection strip has been removed (swimming wear) or if the items are soiled (lingerie) and will be returned to you.
All returns should be sent back in their original packaging provided. Please ensure when returning the parcel that the packaging is properly protected.

Gift returns
If you have received an item from BySymphony as a gift, you can exchange it for another item of the same value, but must pay the additional shipping, taxes, import duties and any additional charges which may incur as a result of the exchange. Passing of property and risk
BySymphony retains legal ownership of the Product(s) until full payment has been made and such payment has been received. Legal ownership of the Product(s) will immediately revert to BySymphony, if payment is refunded to you. Risk on the Product(s) will pass to you upon delivery.

Disputes
To the fullest extent permitted by applicable law, any dispute relating in any way to your visit to the Website and any purchase by you of any items from BySymphony shall be submitted to confidential arbitration in Dubai, except that, to the extent you have in any manner violated or threatened to violate BySymphony’s intellectual property rights, BySymphony may seek injunctive or other appropriate relief in the U.A.E. Courts, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the International Chamber of Commerce. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. To the extent arbitration is not permitted by applicable law, any dispute relating in any way to your visit to the Website shall be submitted to an appropriate court or other judicial body in Dubai, and all applicable provisions of this section shall apply.
